VEHICLE RENTAL TERMS AND CONDITIONS

These Vehicle Rental Terms and Conditions (“Terms and Conditions”) establish the rules and requirements applicable to the rental and use of vehicles owned, leased, or otherwise operated by Sky N Hossain LLC (“Company”). These Terms and Conditions apply to every renter (“Renter”) who rents or possesses a Company vehicle.1. RENTAL PERIODThe rental period begins at the date and time agreed upon between the Company and Renter and continues on a weekly basis unless terminated, renewed, or otherwise modified in accordance with the applicable rental agreement and law.
The Renter has no right to retain possession of the vehicle after the rental period ends or after the rental is lawfully terminated.
Upon lawful termination, the Renter must promptly return the vehicle to the location designated by the Company.2. WEEKLY RENTAL PAYMENTThe standard weekly rental payment is $360.00, consisting of:
• Vehicle Rental Fee: $310.00 per week
• Insurance/Coverage-Related Fee: $50.00 per week (subject to change without prior notice)
• Total Weekly Payment: $360.00
The weekly payment is due every Wednesday.
Payment must be received by the Company on or before Wednesday of each rental week.
The Renter remains responsible for the weekly payment regardless of whether the vehicle is used on a particular day during the rental week, unless otherwise agreed to in writing.
Failure to make a required payment when due constitutes a default and may result in termination of the rental and recovery of the vehicle, subject to applicable New York law.
Additional amounts properly owed under these Terms and Conditions may be charged separately.3. COMMERCIAL INSURANCEThe Company maintains commercial automobile insurance for applicable rental vehicles.
The Renter acknowledges that insurance coverage is subject to the applicable commercial insurance policy, including all terms, conditions, exclusions, limitations, deductibles, and requirements.
The $50.00 weekly insurance/coverage-related fee is a separate charge associated with the rental arrangement. Payment of this fee does not guarantee coverage for every type of loss, damage, expense, or liability.
The actual insurance coverage applicable to any vehicle is determined by the Company's commercial insurance policy and applicable law.
The Renter must provide truthful and accurate information to the Company and, when required, to the Company's insurance carrier.
The Renter must immediately notify the Company of any accident, collision, theft, vandalism, damage, loss, or other incident involving the vehicle.
The Renter must fully cooperate with the Company and its insurance carrier regarding claims, investigations, and required documentation.
Nothing in these Terms and Conditions expands or changes the coverage provided by the Company's insurance policy.4. TIRES AND RIMSUnless otherwise required by applicable law or specifically covered by the applicable insurance policy, damage to tires and rims is not covered under the rental's stated insurance/coverage arrangement.
The Renter may be responsible for the reasonable cost of repairing or replacing tires or rims damaged while the vehicle is in the Renter's possession, including damage caused by:
• Potholes;
• Curbs;
• Road debris;
• Tire punctures;
• Curb rash;
• Bent rims;
• Cracked rims;
• Improper tire pressure;
• Driving on a damaged or flat tire;
• Impact damage;
• Misuse or negligence; or
• Other damage attributable to the Renter's use or possession of the vehicle.
The Renter must immediately notify the Company if a tire becomes damaged, loses air, or appears unsafe.5. VEHICLE CONDITIONThe Renter is responsible for inspecting the vehicle before taking possession and notifying the Company of any pre-existing damage or condition that has not been documented.
The Company may photograph or video-record the vehicle before and after the rental period to document its condition.
Photographs, videos, inspection reports, odometer readings, fuel readings, and other records may be used to document the vehicle's condition.
The Renter is responsible for damage occurring during the rental period to the extent provided by the rental agreement, applicable insurance policy, and New York law.6. CLEANLINESS AND CLEANING FEEThe Renter must return the vehicle in a reasonably clean condition.
The vehicle must be returned free from excessive trash, food, dirt, mud, stains, spills, excessive odors, and other excessive mess caused by the Renter or occupants.
If the vehicle requires cleaning beyond ordinary routine cleaning because of the Renter's use, the Company may charge a $300 cleaning fee.
Examples that may result in the cleaning fee include:
• Excessive food or drink spills;
• Excessive trash or debris;
• Mud or excessive dirt inside the vehicle;
• Excessive stains;
• Excessive pet hair or animal-related mess;
• Smoking or smoke-related residue or odor;
• Strong or excessive odors;
• Excessive sand or similar material; or
• Other excessive interior contamination caused during the rental period.
The Company may document the vehicle's condition with photographs, videos, inspection reports, or other records before assessing the cleaning fee.
The $300 cleaning fee does not prevent the Company from seeking additional amounts for actual damage when permitted by the rental agreement and applicable law.7. AUTHORIZED DRIVERSOnly the Renter and persons expressly authorized in writing by the Company may operate the vehicle.
The Renter must not allow an unauthorized person to operate the vehicle.
The Renter remains responsible for the vehicle while it is in the Renter's possession, including use by any person whom the Renter permits to operate the vehicle, to the extent permitted by law.8. DRIVER'S LICENSE AND ELIGIBILITYThe Renter must possess a valid driver's license appropriate for operating the rental vehicle.
The Renter must provide accurate information concerning identity, driver's license information, driving history, and other information reasonably requested by the Company or required by the Company's insurance carrier.
The Company may refuse or terminate a rental when legally permitted if the Renter does not satisfy applicable licensing, eligibility, insurance, or safety requirements.9. PROHIBITED USEThe Renter shall not:
1. Use the vehicle for any illegal purpose;
2. Permit an unauthorized person to drive the vehicle;
3. Operate the vehicle while impaired by alcohol, drugs, or any substance affecting driving ability;
4. Use the vehicle for racing, speed testing, or similar activities;
5. Operate the vehicle recklessly, abusively, or dangerously;
6. Use the vehicle to transport illegal or hazardous materials;
7. Subrent, rent, lend, sell, transfer, or otherwise give possession of the vehicle to another person;
8. Use the vehicle in violation of the Company's insurance policy;
9. Use the vehicle outside geographic or operational restrictions imposed by the Company or its insurer;
10. Make unauthorized modifications to the vehicle; or
11. Use the vehicle for any purpose prohibited by applicable law.
A violation of this section may constitute grounds for termination of the rental, subject to applicable law.
10. NO SUBRENTAL OR TRANSFER
The Renter shall not:
• Subrent the vehicle;
• Rent the vehicle to another person;
• Lend the vehicle;
• Transfer possession of the vehicle;
• Assign the rental arrangement; or
• Allow another person to take control of the vehicle
without the Company's prior written authorization.11. MAINTENANCE AND MECHANICAL PROBLEMSThe Renter must operate the vehicle responsibly and promptly notify the Company of any:
• Mechanical problem;
• Warning light;
• Unusual noise;
• Tire problem;
• Safety issue; or
• Other condition that may affect the safe operation of the vehicle.
The Renter must not ignore warning lights or continue operating the vehicle when doing so could reasonably cause additional damage.
The Renter must not authorize major repairs without the Company's prior authorization12. ACCIDENTS AND DAMAGEIn the event of an accident or collision, the Renter must:
• Stop the vehicle and remain at the scene when legally required;
• Contact emergency services when appropriate;
• Contact law enforcement when required or appropriate;
• Exchange required information with other involved parties;
• Notify the Company immediately;
• Cooperate with the Company's insurance carrier; and
• Provide information and documentation reasonably requested concerning the incident.
The Renter must not make admissions of liability or enter into a settlement on behalf of the Company or its insurance carrier.
• If you are at fault you may lose the right to rent from us and your rental agreement with us may get terminated instantly. if we decide to rent to you in future or don't terminate our rental agreement then you have to pay higher insurance fee from that moment forward.13. THEFT, VANDALISM, OR LOSSThe Renter must immediately notify the Company and appropriate law enforcement if the vehicle is stolen, vandalized, lost, or otherwise unlawfully taken.
The Renter must cooperate fully with law enforcement, the Company, and the Company's insurance carrier.
The Renter must provide information and documentation reasonably requested in connection with the incident.14. TOLLS, TICKETS, PARKING, AND OTHER CHARGESThe Renter is responsible, to the extent permitted by law, for charges incurred during the Renter's possession or use of the vehicle, including:
• Tolls;
• Parking charges;
• Parking violations;
• Traffic violations;
• Red-light violations;
• Speed-camera violations;
• Towing charges;
• Storage charges;
• Impound charges; and
• Other governmental or third-party charges.
The Renter must promptly reimburse the Company for amounts properly charged to the Company as a result of the Renter's use or possession of the vehicle.15. RETURN OF VEHICLEWhen the rental period ends or the rental is lawfully terminated, the Renter must return the vehicle to the location designated by the Company.
The vehicle must be returned with:
• All keys;
• Registration documents provided by the Company;
• Equipment provided with the vehicle;
• Accessories provided with the vehicle; and
• All personal belongings removed.
The vehicle must be returned in substantially the same condition in which it was received, subject to ordinary wear and tear and the terms of the applicable rental agreement.
Failure to return the vehicle as required may result in additional charges and legal remedies available to the Company.16. FUELUnless otherwise agreed in writing, the Renter must return the vehicle with approximately the same fuel level documented at the beginning of the rental period.
If the vehicle is returned with less fuel than required, the Company may charge the reasonable cost of replacing the missing fuel and any service or administrative charge permitted by law.17. PERSONAL PROPERTYThe Renter is responsible for removing all personal belongings from the vehicle before returning it.
The Company is not responsible for personal property left inside the vehicle after the vehicle has been returned, except as otherwise required by applicable law.18. PAYMENT AUTHORIZATIONThe Renter agrees to pay all amounts properly owed under the applicable rental agreement and these Terms and Conditions.
Amounts may include, where applicable:
• Weekly rental fees;
• Insurance/coverage-related charges;
• Tire and rim repair or replacement costs;
• Cleaning fees;
• Tolls;
• Parking charges;
• Traffic violations;
• Towing and storage charges;
• Damage-related amounts; and
• Other charges expressly permitted by the rental agreement and applicable law.
The Company may use a payment method properly authorized by the Renter to collect amounts properly due, subject to applicable law and any required disclosures or authorization.19. COMPANY'S RIGHT TO REFUSE OR TERMINATE RENTALThe Company may refuse, suspend, or terminate rental service when permitted by applicable law.
Grounds may include:
• Failure to make a required payment;
• Violation of the rental agreement or these Terms and Conditions;
• False or misleading information;
• Unauthorized use of the vehicle;
• Prohibited use of the vehicle;
• Violation of applicable insurance requirements;
• Damage or abuse of the vehicle;
• Failure to maintain the vehicle in a reasonably safe condition;
• A material safety or insurance concern; or
• Any other lawful basis for termination.
Nothing in these Terms and Conditions authorizes termination for a reason prohibited by federal, New York State, or other applicable law.
Upon lawful termination, the Renter must promptly return the vehicle as directed by the Company.20. COMPLIANCE WITH LAW AND INSURANCE REQUIREMENTSThe Renter must comply with all applicable federal, New York State, Suffolk County, and local laws and regulations governing the use and operation of the vehicle.
The Renter must also comply with applicable requirements of the Company's commercial insurance policy.
If any provision of these Terms and Conditions conflicts with a mandatory requirement of applicable law or the Company's insurance policy, the mandatory requirement shall control.21. NO WAIVER OF NON-WAIVABLE RIGHTSNothing in these Terms and Conditions is intended to waive, release, or limit any right or protection that cannot legally be waived, released, or limited under applicable law.22. SEVERABILITYIf any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision shall be modified or severed only to the extent necessary, and the remaining provisions shall remain in effect to the fullest extent permitted by law.23. GOVERNING LAWThese Terms and Conditions shall be governed by the laws of the State of New York, except to the extent federal law or another mandatory applicable law provides otherwise.
Any legal proceeding shall be brought in a court or forum having proper jurisdiction and venue under applicable law.24. RELATIONSHIP TO RENTAL AGREEMENTThese Terms and Conditions are intended to be incorporated into and used together with the Company's applicable Vehicle Rental Agreement.
If there is a conflict between these Terms and Conditions and a specific written rental agreement, the terms of the applicable rental agreement shall control to the extent permitted by law.25. ACKNOWLEDGMENTBy renting or taking possession of a vehicle from Sky N Hossain LLC, the Renter acknowledges that the Renter is required to comply with these Terms and Conditions, the applicable Vehicle Rental Agreement, applicable insurance requirements, and applicable law.
